Elektronik ticaret işlemleri ile kişisel verilerin korunması

Abstract

Bilişim teknolojilerinde yaşanmış ve yaşanmaya devam eden ilerleme ve gelişmeler, insan hayatını sadece olumlu yönde etkilemiş olmayıp, insan hayatına olumsuz etkileri de olmuştur. Yaşanan değişimler, bireylerin mahremiyetini ve özel hayatını herkesin gözü önüne seren uygulamalar ile internetin ve sosyal medyanın gelişimi ile toplanan verilerin güvenliğinin nasıl sağlanacağı endişelerini getirmiştir. Bu durum, toplumu kişisel veriler ve kişi özel hayatının korunması ile alakalı çözüm arayışlarını da beraberinde getirmiştir. Kişinin, kendisinin kendi verilerinin geleceğini tayin etme hakkı bulunur. Bu doğrultuda kişinin kişisel verilerin korunması hususunda gerek ulusal, gerek uluslararası alanlarda pek çok düzenlemelerin yapılması ihtiyacı doğmuştur. Kişisel Verilerin Korunması ve E-Ticaret alanlarında Türkiye, Anayasal ve yasal düzeyde öngörülmüş pek çok düzenlemeye sahiptir. Özelikle 6698 sayılı Kişisel Verilerin Korunması Kanunu’nun yürürlüğe girmesi ile kişisel verilerin korunması hususunda ilerlemeler kaydedilmiş ve veri ihlallerinin önüne geçilmeye başlanmıştır. Bu çalışmada, özelikle Elektronik Ticaret İşlemleri ve Kişisel Verilerin Korunması hususları incelenmiş olup, özelikle 6698 sayılı Kişisel Verilerin Korunması Kanunu, 6563 Sayılı Elektronik Ticaretin Düzenlenmesi Hakkında Kanun, Avrupa Birliği mevzuatı ve diğer uluslararası metinler çerçevesinde Elektronik Ticaret ve kişisel verilerin işlenmesi kavramları incelenmiştir. Çalışma, üç ana bölümden oluşmaktadır. İlk bölümde Elektronik Ticaret ve Elektronik Sözleşmeler kavramları genel hatlarıyla açıklanmıştır. Elektronik ticaretin türleri belirtilmiştir. İkinci bölümde, Kişi, Kişisel Veri incelenmiş olup Kişisel Verinin Korunması hususu genel olarak ele alınmıştır. Üçüncü ve son bölümde ise Elektronik Ticarette Kişisel Verilerin Korunması hususu ele alınmış olup Elektronik Ticarette Rıza kavramı ve Elektronik Ticarette Kişisel Verilerin Korunmasının Sorumluluğu kavramları bu bölüme dahil edilmiştir. Progress and developments in information technologies, which have been and continue to be experienced, have not only affected human life positively, but also had negative effects on human life. The changes experienced have brought concerns about how to ensure the security of the data collected with the development of the internet and social media, with the applications that reveal the privacy and private life of individuals. This situation has brought the society to seek solutions related to the protection of personal data and private life. The individual has the right to determine the future of his/her own data. In this direction, the need for many regulations has arisen in both national and international fields regarding the protection of personal data. In the fields of Protection of Personal Data and ECommerce, Turkey has many regulations stipulated at the constitutional and legal level. In particular, with the entry into force of the Law on Protection of Personal Data No.6698, progress has been made in the protection of personal data and data breaches have begun to be prevented. In this study, particularly Electronic Commerce Transactions and Protection of Personal Data are examined. In addition, the concepts of Electronic Commerce and personal data processing are examined are examined within the scope of the Law on Protection of Personal Data No. 6698, the Law No. 6563 on the Regulation of Electronic Commerce, the European Union legislation and other international texts. The study consists of three main parts. In the first part, the concepts of Electronic Commerce and Electronic Contracts are explained in general terms, and types of electronic commerce are specified. In the second part, the data subject and Personal Data notions are examined and the Protection of Personal Data is discussed in general. In the third and last part, the issue of Protection of Personal Data in Electronic Commerce is discussed and the concept of Consent in Electronic Commerce and Responsibility for Protection of Personal Data in Electronic Commerce are included in this section.
