Kamu disiplin hukukunun genel görünümü ve millî savunma üniversitesinde görev yapan sivil akademik personelin durumu

Abstract

Disiplin, Devlet ve diğer kamu tüzel kişilerinde çalışan kişilerin uymakla yükümlü oldukları ve uymamaları halinde çeşitli yaptırımlarla karşılaştığı bir düzen olarak tanımlanabilir. Ülkemizde, kamu personellerinin disiplin hukukuna ilişkin temel hukuki düzenlemelere bakıldığında karşımıza, 657 sayılı Devlet Memurları Kanunu, 2547 sayılı Yükseköğretim Kanunu, 6413 sayılı Türk Silahlı Kuvvetleri Disiplin Kanunu başta olmak üzere burada zikredilmeyen diğer düzenlemeler çıkmaktadır. Bu düzenlemelerin kurumlarda görevli hangi statüdeki personele uygulanacağı önemli bir husustur. Millî Savunma Üniversitesi (MSÜ) 2016 yılında Millî Savunma Bakanlığına bağlı olarak kurulan ve kendisine harp okulları ile diğer askerî kurumlarının bağlandığı, ordumuza askerî personel yetiştirme gibi yegane ve özel bir görev ve sorumluluğa sahip olan, ülkemizin önemli kurumlarından birisidir. MSÜ, bünyesinde farklı statülerde kamu personelleri istihdam etmektedir. Bu statüler; Subay, astsubay ve diğer askerî personeller, Devlet memurları ve akademik faaliyetler de icra etmesi sebebiyle akademik personellerdir. Çalışmamızda, MSÜ bünyesinde görev yapan sivil akademik personelin disiplin soruşturması usulü incelenmiştir. Bu kapsamda, çalışmamızın birinci bölümünde disiplin kavramı incelenmiş, disiplin hukuku ilkeleri ortaya konulmuş, disiplin soruşturmasına benzer kavramlar açıklanmıştır. İkinci bölümde, MSÜ’nün bünyesinde farklı statüde personeller istihdam etmesi sebebiyle MSÜ’de görev yapan personellerin statüsü incelenmiştir. Üçüncü bölümde, 2547 sayılı Kanun’a göre disiplin soruşturması usulü detaylı bir şekilde açıklanmıştır. Dördüncü bölümde ise 657 sayılı Kanun’a göre disiplin soruşturması usulü, üçüncü bölümde izah edilen ve Devlet memurlarının disiplin soruşturması için de geçerli olan konulara tekraren yer verilmeyerek açıklanmıştır. Discipline can be defined as an order that people working in the State and other public legal entities are obliged to comply with and face various sanctions if they do not comply. In our country, when we look at the basic legal regulations regarding the disciplinary law of public personnel, we encounter other regulations not mentioned here, especially the Civil Servants Law No. 657, the Higher Education Law No. 2547, and the Turkish Armed Forces Discipline Law No. 6413. It is an important issue in which status these regulations will be applied to the personnel working in the institutions. The National Defense University (MSU) is one of the important institutions of our country, which was established in 2016 under the Ministry of National Defense and has the unique and special duty and responsibility of training military personnel for our army, to which the war schools and other military institutions are connected. MSU employs public personnel of different statuses within its body. These statuses are; Officers, noncommissioned officers and other military personnel are civil servants and academic personnel due to their academic activities. In our study, the method of disciplinary investigation of the civilian academic staff working in MSU has been tried to be explained. In this context, in the first part of our study, the concept of discipline was examined, the principles of disciplinary law were revealed, and concepts similar to disciplinary investigation were tried to be explained. In the second part, the status of the personnel working in MSU has been tried to be explained, since MSU employs personnel with different status. In the third part, the disciplinary investigation procedure according to the Law No. 2547 has been tried to be examined in detail. In the fourth chapter, the disciplinary investigation procedure according to the Law No. 657 has been tried to be explained by not including the issues explained in the third chapter and which are also valid for the disciplinary investigation of civil servants.
