Yargılamaya egemen olan ilkelere uyulmamasının sonuçları

Abstract

Medeni yargılamaya egemen olan ilkelerden tasarruf ilkesi ve bu ilkeyle bağlantılı olan taleple bağlılık ilkesi, taraflarca getirilme ilkesi, teksif ilkesi yargılamanın temelini oluşturur. Bu ilkelerin özellikle medeni yargılama sisteminin temel niteliğini teşkil etmesi ve her uyuşmazlıkta bu ilkeler dikkate alınarak yargılamanın devamlılığının esas alınması gerekir. Hukuk Muhakemeleri Kanunu ile birlikte yargılama hukukuna egemen olan ilkelerin birçoğu kanunda sayılsa da, bahse konu ilkelere riayet edilmemesi sonucunda kanunen herhangi bir yaptırım öngörülmemiştir. Yargılama süreci boyunca göz önünde tutulması gereken bu ilkelere aykırı hareket edilmesinin ne anlama geleceği, hangi durumlarda ilkelerin ihlalinin söz konusu olacağı ve ilkelere aykırılık halinde ne tür hukuki yollara müracaat edileceği çalışmamızda açıklanmaya çalışılmıştır. The disposition principle and the principles in relation to this principle, i.e. the principle of adherence to plea, the principle of contest and the principle of concentration, form the basis of the civil proceedings. It is especially required for these principles to constitute the essential character of the civil proceedings system and to be taken into consideration in every dispute in order to provide the continuity of the proceedings. Even though most of the dominating principles of civil proceedings are enumerated in the Code of Civil Procedure, no legal sanction is provided as a consequence of not complying with these principles. In this dissertation, the meaning of not complying with these principles needing be taken into account through the civil proceedings, what constitutes the violation of these principles, and which legal remedies are to be invoked in case of violation of these principles are attempted to be elucidated.
