İşçinin iş görme ediminde ifa engelleri ve ücret

Abstract

İşçinin iş görme ediminde ifa engelleri ve ücret konusunun ele alındığı çalışmanın amacı; işçi ile işveren arasında yapılan iş sözleşmesinin, işçi tarafına yüklediği iş görme borcunun yerine getirilmemesi sonucunu ortaya çıkaran durumlar ve bu durumların işçinin ücretine ilişkin sonuçlarının incelenmesidir. İşçinin iş görme ediminde ifa engelleri ve ücret konusu; İş Kanunu, İş Sağlığı ve Güvenliği Kanunu, Türk Borçlar Kanunu ve yüksek mahkeme kararları kapsamında ele alınarak incelenmiştir. Bu çalışmada farklı kanunlarda yer alan hükümler bir arada değerlendirilmiş, doktrindeki görüşlere yer verilmiş ve gerektiği yerde yargı kararlarına başvurularak işçinin iş görme ediminin ifa engelleri halinde ücretinin kapsamı ortaya koyulmuştur. The purpose of the study that had been discussed the barriers to performance of the worker and wages; is the examination of the situations that result in the failure to fulfill the obligation to work that obligated by the contract between the worker and the employer, and the consequences of the workers' wages. Worker's barriers to performance in performance of work and wages; is examined in the scope of Labor Law, Occupational Health and Safety Law, Turkish Code of Obligations and High Court decisions. In this study, the provisions in different laws were evaluated together, the opinions in the doctrine were included, and if necessary, the scope of the wage is indicated in the result of the workers’ barriers to perform in regards to the judicial decision.
