Vekâlet Sözleşmesi

Abstract

Günümüzde, ekonomik gelişmelere bağlı olarak hizmet sektörü de hızlı bir biçimde büyümüştür. Bu durum iş görme sözleşmelerinin hem çeşitliliğini hem de önemini artırmıştır. Vekâlet sözleşmesi, uygulama alanı büyük oranda genişleyen iş görme sözleşmelerinin en önemlilerinden biridir. Vekâlet sözleşmesi, Türk Borçlar Kanunu (TBK) m. 502/1’e göre, vekilin vekâlet verenin bir işini görmeyi veya bir işlemini yapmayı üstlendiği sözleşmedir. Vekâlet sözleşmesinin özellik ve önemi nedeniyle bu çalışmamızda, söz konusu sözleşmenin genel özellikleri, unsurları, tarafları, tarafların yükümlülükleri ve sözleşmenin sona erme nedenleri ayrıntılı olarak incelenecektir. Çalışmamız sonunda vardığımız önemli noktalar, sonuç kısmında ayrıca belirlenecektir. Bu çalışmamızda, TBK’da düzenlenmiş olan vekâlet sözleşmesi asıl olmakla birlikte gerekli hallerde Avukatlık Kanunu’nda yer alan Avukatlık Sözleşmesine de yer verilecektir. Today, depending on the economic developments, the service sector has grown rapidly. This situation has increased both the diversity and importance of employment contracts. The power of attorney contract is one of the most important of the employment contracts, the scope of which is greatly expanded. A contract of attorney is a contract in which the attorney undertakes to perform a job or perform a transaction of the attorney, according to article 502, paragraph 1 of the Turkish Code of Obligations (TCO). Due to the nature and importance of the power of attorney agreement, in this study, the general features, elements, parties, obligations of the parties and the reasons for the termination of the agreement will be examined in detail. The important points we reached at the end of the studies will be determined separately in the conclusion part. In this study, although the power of attorney agreement regulated in the TCO is the original, the Attorneyship Agreement in the Attorneyship Law will also be included when necessary.
