Terekenin korunması önlemlerinden terekenin resmen yönetilmesi

Abstract

Mirasbırakanın ölümü ile tüm mirası yasal ve atanmış mirasçılarına bir bütün halinde geçer. Mirasbırakanın ölümü ile terekesi hak sahipleri tarafından bilinmeyebilir, mirasçılar tespit edilemeyebilir. Böyle bir durumda terekenin hak sahiplerine geçinceye kadar kaybolması, zarara uğraması ihtimallerinin bertaraf edilmesi gerekebilir. Kanunumuzda terekenin korunması önlemleri TMK’nın 589-594 maddeleri arasında belirtilmiştir. Kanun koyucu terekenin korunması önlemlerini sınırlı sayıda saymamış, her durumun özelliğine göre hâkime takdir yetkisi tanımıştır. Çalışmamın konusunu, mirasbırakanın ölümü ile ardında bıraktığı mal varlığının hak sahiplerine geçişine kadar korunması önlemlerini oluşturmaktadır. Birinci bölümde, tereke kavramı ve terekeye hâkim olan ilkeler açıklanmıştır. İkinci bölümde, terekenin korunması önlemleri yer almaktadır. Üçüncü bölümde ise, terekenin korunması önlemlerinden olan terekenin resmen yönetilmesi hususu detaylı olarak incelenmiştir. Son bölümde ise değerlendirme yer almaktadır. With the death of the heir, all his estate passes to his legal and appointed heirs intact. The estate may not be known to the beneficiaries, and the heirs may not be identified with the death of the heir. In such a case, it may be necessary to eliminate the possibility of loss and damage until the estate passes to the beneficiaries. In our law, the protection measures of the estate are specified among the articles 589-594 of the TMK. The legislator does not regard the protection measures of the law in a limited number but grant the judge discretion according to the characteristics of each situation. The subject of this work is the protection measures of the estate until the death of the heir and the transfer of the assets left behind to the beneficiaries. In the first chapter, the concept of estate and the principles that establish estate are explained. In the second part, measures protecting the estate are discussed. In the third part, the issue of formal management of the estate, one of the protection measures of estate, is examined in detail. In the last section, an evaluation is made.
