Abstract

Devletlerin ordu teşkilatlarının en önemli başarı ölçütlerinden biri şüphesiz sahip oldukları askerî disiplindir. Disiplin de hizmete ilişkin emirlere itaat edilmesi ile mümkündür. Kasıtlı olarak yerine getirilmeyen emirlerden dolayı AsCK md.87’de düzenlenen emre itaatsizlikte ısrar suçu oluşabilir. Çalışmada emre itaatsizlikte ısrar suçu, öğretideki görüşler ile kapatılan askerî mahkemeler ve genel mahkemelerin kararlarından faydalanarak suçun unsurları ve diğer yönlerden inceleme altına alınmıştır.One of the most important success criteria of the military organizations of states is undoubtedly their military discipline. Discipline is only possible through obedience to orders related to service. Insistence on Disobeying an Order regulated under article 87 of the Military Penal Code may occur due to orders that are not intentionally fulfilled. In this study, Insistence on Disobeying an Order is examined in terms of the elements of the crime and other aspects by making use of the discussions in the doctrine and the case law of the closed military courts and general courts.
