    İcracı oyuncu sözleşmesi

    Bir sinema eserinin ortaya çıkarılması amacıyla yapılan ve çok sayıda kişinin organize bir şekilde çalışmasını gerektiren sözleşmelerden biri de icracı oyuncu sözleşmesidir. Çalışmamızda icracı oyuncu sözleşmesinin hem fikir ve sanat eserleri hukuku hem de borçlar hukuku disiplinleri kapsamında ele alınarak sözleşmeye ilişkin temel özelliklerin açıklanması amaçlanmaktadır. Çalışmamızın birinci bölümünde icracı oyuncu sözleşmesinin tanımı yapılmış, özellikleri ve unsurları belirlenmiştir. Daha sonra sözleşmede tarafların kimler olabileceği ve sahip oldukları özellikler anlatılmıştır. Sözleşmenin hukukî anlamda nitelendirilerek sözleşmeye hangi hükümlerin uygulanacağı belirlenmeye çalışılmıştır. Benzer sözleşmelerle karşılaştırmasının yapılmasıyla birinci bölüm sonlandırılmıştır. İkinci bölümde, icracı oyuncu sözleşmesinde icracı oyuncu ve yapımcının hak ve borçları detaylı bir şekilde incelenmiştir. Çalışmamızın son bölümünü oluşturan üçüncü bölümde ise icracı oyuncu sözleşmesinin sona erme halleri açıklanmıştır. One of the contracts requiring the organized effort of numerous individuals for the creation of a cinematic work is the performer's contract. In our study, it is aimed to explain the basic features of the performer's contract within the domains of intellectual property law and obligations law. In the first chapter, the definition of the performer's contract is made, its characteristics and essential elements are determined. Then, the parties to the contract and their characteristics are explained. It is tried to determine which provisions will be applied to the contract by characterizing the contract in legal terms. The first part is concluded with a comparison with similar contracts. In the second chapter, the rights and obligations of the performer and the producer in the performer-actor contract are meticulously examined. The final chapter, constituting the third part of our study, the termination of the performer-actor contract is explained.
