    Birlikte kefalet

    6098 sayılı Türk Borçlar Kanununun on beşinci bölümünde 581 ile 603üncü maddeler arasında düzenlenen kefalet sözleşmesi bir kimsenin borcunu ödememesi veya temerrüdü neticesinde bir kefilin borcun alacaklısına ödemeyi tazmin yükümlülüğü altına girdiği teminat sözleşmesidir. Bu çalışmamızda kefaletin türlerinden olan birlikte kefalet incelenecek olup, öncelikle kefalet tanımlanmış, daha sonra kefaletin geçerlilik şartları, kefaletin türleri, kefil ve alacaklı arasındaki ilişkiler, kefil ile borçlu arasındaki ilişkiler genel olarak açıklanmıştır. Son olarak asıl konumuz olan birlikte kefalet incelenmiş, birlikte kefaletin türleri açıklanmış ve birlikte kefile borçtan kurtulma hakkı tanıyan TBK m.587/3 anlatılmıştır. Contracts of guarantee held between articles 581 and 603 in the fifteenth section of the Turkish Law of Obligations numbered 6098 is a surety contract in which a guarantee is obliged to compensate the creditor of the debt as a result of a person's failure to pay or default. In this study, co-guarantee which is type of guarantee will be examined, first the guarantee is defined, then the validity conditions of the guarantee, the types of guarantee, the relations between the guarantee and the creditor, the relations between the guarantee and the debtor are explained in general. Finally, our main issue is that the co-guarantee was examined together, the types of co-guarantee were explained, and Turkish Obligation Code Art.587/3, which gives the guarantee the right to get rid of the debt, have been described.
