    Askerî ceza hukukunda amir ve üste hakaret suçu

    Şeref, onur ve haysiyet kavramları insanın toplum içeresindeki rolünü etkileyen en temel değerlerdir. Sosyal düzenin sağlanmasında bireylere ait bu değerlerin korunması büyük önem arz etmektedir. Türk Silahlı Kuvvetleri de kendi içerisinde sıkı düzen kurallarının bulunduğu bir topluluk olarak; amir veya üst konumundaki kişilerin şeref, onur ve saygınlığını korumak ve askeri disiplin ile mutlak itaat anlayışını sağlamlaştırmak suretiyle gerçekleştirdiği faaliyetlerde başarılı olmayı hedefler. Amir veya üstlere karşı kasıtlı olarak gerçekleştirilen tahkir edici fiillerin engellenmesi ordunun elde edeceği başarılara giden yolda kilit bir rol oynamaktadır. Bu nedenle, Askeri Ceza Kanunu’nun 85’inci maddesinde amir veya üste hakaret edenlerin cezalandırılması öngörülmüştür. Çalışmamızda amir veya üste karşı hakaret suçu, doktrinde yer alan görüşler ile mevcut yüksek mahkeme ve kapatılan askeri yüksek mahkeme içtihatlarından da yararlanmak suretiyle incelenecektir. The concepts of honor, dignity and self-dignity are the most fundamental values that affect the role of humans in society. Protecting these values of individuals is of great importance in ensuring social order. Turkish Armed Forces, as a community with strict rules of order; It aims to be successful in its activities by protecting the honor, dignity and esteem of those in superior positions and by strengthening the understanding of military discipline and absolute obedience. Preventing deliberate defamation acts against commanders or superiors play a key role on the path to the success of the army. For this reason, Article 85 of the Military Penal Code stipulates that those who insult their commanders or superiors will be punished. In our study, the crime of defamation against a commander or a superior will be examined by making use of the opinions in the doctrine and the jurisprudence of the current supreme court and the closed military court of cassation.
