    Avrupa insan hakları sözleşmesi ışığında adil yargılanma hakkının genel kolluk disiplin rejiminde uygulanması

    Ülkemizdeki genel kolluk teşkilatı, Jandarma Genel Komutanlığı, Sahil Güvenlik Komutanlığı ve Emniyet Genel Müdürlüğü’nden oluşmaktadır. Bu çalışmada; yargılama sürecinin hukuka uygun şekilde işlemesini, temel hak ve özgürlüklerin etkin bir şekilde korunmasını sağlayan adil yargılanma hakkının genel kolluk disiplin rejiminde uygulanması ele alınarak; bu hususlar öğretideki görüşler ve yargı kararları çerçevesinde anlatılmıştır. Disiplin kavramı, kamusal alandaki hizmet ve faaliyetlerin etkili ve verimli şekilde sürdürülmesi amaçlamaktadır. Disiplin rejimi, personelin kurumla ilişki şeklini belirleyen, koruyan ve yıprandığında onarılmasını sağlayan kurallar ve uygulamalar bütünüdür. Adil yargılanma hakkının Avrupa İnsan Hakları Sözleşmesi ve Avrupa İnsan Hakları Mahkemesi kararlarından yola çıkarak genel kolluk disiplin rejimindeki etkisi incelenmiştir. The general law enforcement organization in our country consists of the Gendarmerie General Command, the Coast Guard Command and the General Directorate of Security. In this study, the application of the right to a fair trial, which ensures that the judicial process operates by the law and that fundamental rights and freedoms are effectively protected, in the general law enforcement disciplinary regime is considered and these issues are explained within the framework of the opinions in the doctrine and judicial decisions. The concept of discipline aims to maintain services and activities in the public sphere effectively and efficiently. A disciplinary regime is a set of rules and practices determining, and protecting the relationship of the personnel with the institution and repairing the aforementioned relationship when it is worn out. The inclusion of the right to a fair trial in the general law enforcement disciplinary regime, based on the decisions of the European Convention on Human Rights and the European Court of Human Rights, is also explained in this study.
