Sponsorluk Sözleşmesi
Özet
Sponsorluk kavramı, rekabet ortamının her geçen gün arttığı modern dünyanın bir
ürünü olarak ortaya çıkmıştır. Sponsorluk kavramı, geçmişte karşılıklı menfaat ilişkisine
dayanmamakta iken, günümüzde her iki tarafın da menfaat güttüğü bir sözleşme haline
dönüşmüştür. Günlük yaşamımızda sıklıkla karşılaştığımız sponsorluk ilişkisi, hukuk
sistemimizde özel olarak bir düzenlemeye sahip olmadığından bu durum çalışmamız
konusunu belirlememizde büyük rol oynamıştır. Sponsorluk sözleşmesi; destekleme ve
tanıtım edimlerinden oluşan, tam iki tarafa borç yükleyen, sürekli borç ilişkisi içeren,
ivazlı, isimsiz bir sözleşmedir. Sponsorluk sözleşmesinin hangi türde bir isimsiz sözleşme
olduğu konusunda doktrinde farklı görüşler bulunmasına karşın, öğretide kendine özgü
yapıda bir isimsiz sözleşme olduğu kabul görmektedir. Çalışmamızda sponsorluk
sözleşmeleri, spor veya sanat sponsorluğu gibi özel bir uygulama alanı ile sınırlı
tutulmamış Türk Borçlar Hukuku açısından genel bir incelemeye tabi tutulmuştur.
The concept of sponsorship has emerged as a product of the modern world, where the
competitive environment has ben increasing day by day. While the concept of sponsorship
was not based on a mutual interest relationship in the past, today it has turned into a
contract in which both parties take an advantage. Since the sponsorship relationship that
we frequently encounter in our daily lives does not have a special regulation in our legal
system, this has played a major role in determining the subject of our study. The
sponsorship agreement is an onerous, anonymous contract consisting of support and
promotion performances, which imposes debt on both sides, and includes a permanent debt
relationship. Although there are different views on the doctrine of what type of unnamed
contract the sponsorship agreement is, itgains recognition in the doctrine as the gact that it
is an anonymous contract with its own unique structure. In our study, sponsorship contracts
were not limited to a special application areas such as sports or art sponsorships, butwere
subjected to a general review in terms of Turkish Code of Obligations.
