dc.description.abstractTeknolojik gelişmelere paralelolarak, günümüzde işyeri kavramı esneklik anlayışına paralelolarak genişlemiştir. Tele ve evde çalışma "işyerinde esneklik" anlayışının sonucu ortaya çıkan çalışma şekilleridir. Bunun yanı sıra, kısmi ve belirli süreli iş sözleşmeleri de "sürelerde esneklik" anlayışı sonucu ortaya çıkan ve izmetin işyeri dışında görüldüğü atipik çalışma şekillerindendir.Çalışanın işini kendi evinde gördüğü atipik çalışma şekli evde çalışmadır. Evde çalışma, genellikle kadınların tercih ettiği bir çalışma şeklidir. Bunun en büyük sebebi ise ailevi yükümlülükleridir. Bu çalışma şeklinin, Borçlar Kanunu tasarısında düzenlenmesinden dolayı, Borçlar Kanunundaki hizmet sözleşmelerini anımsatmaktadır. Evde çalışanlar, kimi yazarlara göre işçi iken kimi yazarlara göre ise de "işçi benzeri çalışanlardır". Tele çalışma ise, henüz Türk Hukukunda düzenlenmemiştir. Bu sebepten dolayı, bu tür çalışmanın İş Kanunu kapsamına mı, yoksa Borçlar Kanununa mı alınması gerektiğine ilişkin çeşitli görüşlere değinmiş bulunmaktayız. Baskın görüş, tele çalışmada "işverene bağımlılık" ilişkisinin olmasından dolayı, İş Kanunu'nda düzenlenen iş sözleşmelerinden sayılması gerektiğine ilişkindir. Avrupa Ülkelerinde ise, genelolarak "evde çalışma" yasalarla düzenlenmiş, " tele çalışma" ise evde çalışma düzenlemelerine kıyas yapılarak uygulanmaktadır. The meanIng of "workplace" has expanded nowadays, according to technologic developments. Teleworking and home working are the working types arising from the "Flexibilation of Workplace". On the other hand, part time and limited time employment contracts, are arising from "the flexibilation of work time" and those are the contracts in which the services is performed out of the workplace. Generally, women prefer homeworking in which the employee performs the work at his/her home. The most important reason for this are the family responsibilities. Homeworking seems to have same attribution with the employment contracts regulated at the Code of Obligations, due to the reason that they are regulated at the Draft of the Code Of Obligations. Some of the writers state that teleworkers should be considered in Labour Law as workers and some argue that they should be classified as a different kind of workers. The bill has used the words "employer" and "employee", as we sometimes used, but we would like to point out that those word shall not be confused with the ones used in the Labour Code. In Turkey, there are no legal regulations related with "Teleworking". Due to this, we have pointed out different kinds of opinions whether they should be regulated in the scope of Labour Code or Law Of Obligations. According to the dominant opinion, teleworking should be regulated in Labour Code, due to the "dependent relationship" between employee and employer. In European Countries, generally, there are more legal regulations related with homeworking than teleworking. Teleworking is regulated by comparison to the rules of homeworking.en_US
